1.2. License & Insurance:
HouseTurnUp holds all required licenses, bonds, and insurance as required by the State of California and the City of Los Angeles. Copies are available upon request.

1.3. Scope of Services:
We provide construction, remodeling, and related services including but not limited to: bathroom remodeling, whole-home remodeling, window installation, door installation, ADU construction, patio installation, interior/exterior painting, deck construction, custom stairs, turnkey home construction, and land development.

1.4. Public Offer:
These Terms constitute a public offer. Your request for an estimate, signed proposal, or payment of any deposit constitutes full and unconditional acceptance of these Terms.


2. Estimates and Quotes

2.1. Free On-Site Estimate:
We offer a free, no-obligation on-site estimate. This estimate is not a binding contract. It is an approximation based on information available at the time of the visit.

2.2. Fixed Price Quote:
After the on-site estimate, we provide a written Fixed Price Quote. This quote includes:

  • Detailed scope of work (line by line)

  • Materials to be used (brands, models where applicable)

  • Labor costs

  • Permit fees (if applicable)

  • Timeline (start date and estimated completion date)

  • Total fixed price

2.3. Validity Period:
Fixed Price Quotes are valid for 30 days from the date of issue. After 30 days, prices may change due to material costs, labor rates, or permit fees.

2.4. Quote Acceptance:
To accept a Fixed Price Quote, you must sign the quote document and pay the required deposit (see Section 5). Once signed and deposited, the quote becomes a binding contract.

2.5. Changes to Scope:
If you request changes after signing the quote, we will provide a Change Order (see Section 6). No work outside the original scope will be performed without a signed Change Order.


3. Permit and Legal Compliance

3.1. Permit Responsibility:
HouseTurnUp obtains all required building permits from the City of Los Angeles or applicable local jurisdiction. Permit fees are included in our Fixed Price Quote unless otherwise stated.

3.2. Client Cooperation:
You agree to provide access to the property for inspections and permit-related visits. You also agree to sign any documents required by the city (e.g., owner-builder forms if applicable).

3.3. Unforeseen Conditions:
If city inspectors require additional work beyond the original scope (e.g., upgrading main electrical panel, replacing sewer line), we will provide a Change Order. You are not obligated to approve it. If you decline, the project may be paused or cancelled (see Section 9).

3.4. HOA and Other Approvals:
You are responsible for obtaining any approvals required by your Homeowners Association (HOA), condominium board, or other private entity. HouseTurnUp is not responsible for delays caused by HOA approvals.


4. Timeline and Scheduling

4.1. Start Date:
Construction begins on the date specified in the Fixed Price Quote, provided that:

  • All permits have been issued

  • Deposit has been paid

  • Site is ready (no obstacles, utilities available)

4.2. Estimated Completion Date:
The completion date in the quote is an estimate. We strive to meet it, but delays may occur due to:

  • Weather (rain, extreme heat, wind)

  • City inspection delays

  • Material supplier delays

  • Unforeseen site conditions (e.g., hidden rot, termites, soil issues)

  • Client requested changes

4.3. Force Majeure:
We are not liable for delays caused by events beyond our reasonable control, including but not limited to: natural disasters, strikes, pandemics, government orders, or material shortages.

4.4. Weekly Updates:
We provide weekly photo and video updates every Friday. You will receive a progress report via text, email, or project management portal.


5. Payment Terms

5.1. Fixed Price:
All projects are priced on a fixed-price basis. The price in the signed quote is the total you will pay, unless you approve Change Orders (Section 6).

5.2. Deposit:
A deposit is required to schedule your project. The deposit amount is:

  • 10% for projects under $10,000

  • 10% for projects between 10,000and50,000

  • 10% for projects over $50,000

The deposit is used to order materials, pull permits, and reserve crew time.

5.3. Progress Payments:
Payments are made according to the Payment Schedule in your Fixed Price Quote. A typical schedule:

  • 10% deposit upon signing

  • 30% after demolition and framing (rough-in start)

  • 30% after rough mechanicals (plumbing, electrical, HVAC passed inspection)

  • 25% after finishes and trim-out

  • 5% upon final walkthrough and punch list completion

5.4. Final Payment:
Final payment (usually 5%) is due after final walkthrough and before we hand over keys or warranty binder.

5.5. Accepted Payment Methods:

  • Credit card (Visa, MasterCard, American Express, Discover) – 3% processing fee

  • Debit card – no fee

  • Bank transfer (ACH) – no fee

  • Cash or check – no fee

5.6. Late Payments:
If payment is not received within 7 days of the due date, a late fee of 1.5% per month (18% per annum) will apply. Work may be paused until payment is received.

5.7. No Lien Waiver Until Paid:
We retain the right to file a mechanics lien on your property if final payment is not made within 30 days of project completion.


6. Change Orders

6.1. What is a Change Order:
A Change Order is a written document that modifies the original scope of work, timeline, and/or price.

6.2. When Change Orders are Required:

  • You want to add work not in original scope (e.g., add a window, upgrade tile)

  • You want to remove work from original scope (e.g., skip painting)

  • Unforeseen conditions require additional work (e.g., rotted subfloor, termite damage)

6.3. Change Order Process:

  1. We identify the need for change (or you request it)

  2. We provide a written Change Order with price and timeline impact

  3. You sign the Change Order

  4. We perform the changed work

6.4. No Work Without Change Order:
We will not perform any work outside the original scope without a signed Change Order. You will not be billed for unapproved changes.


7. Warranty

7.1. Labor Warranty:
HouseTurnUp provides a 5-year warranty on all labor for construction, remodeling, and installation services. This warranty covers defects in workmanship (e.g., leaks from improper waterproofing, cracks from poor framing, doors that fail to close properly).

7.2. Material Warranty:
Materials are covered by the manufacturer’s warranty (typically 1–50 years depending on product). We will assist you in filing manufacturer warranty claims but are not responsible for material defects.

7.3. Warranty Exclusions:
The warranty does not cover:

  • Normal wear and tear (paint fading, minor settling cracks)

  • Damage caused by you or third parties

  • Negligence (failure to maintain caulk, sealants, or finishes)

  • Water damage from roof leaks not caused by our work

  • pest damage (termites, rodents)

  • Cosmetic issues you approved in writing

7.4. Warranty Claims:
To file a warranty claim, contact us at [email protected] or (310) 555-8723. We will respond within 3 business days and schedule repair within 14 days.

7.5. Warranty Transfer:
The 5-year labor warranty is transferable to a new owner if you sell your home. You must notify us in writing with the new owner’s contact information.


8. Client Responsibilities

8.1. Site Access:
You must provide us with safe, unobstructed access to the work area. This includes parking for crew vehicles, access to water and electricity, and permission to be on the property during agreed hours (Monday–Friday, 8:00 AM – 5:00 PM, and occasional Saturdays).

8.2. Utilities:
You are responsible for maintaining utility service (water, electricity, gas) throughout the project. If utilities are shut off, work will pause, and you will be charged for crew downtime.

8.3. Personal Property:
You are responsible for removing valuable or fragile items from the work area. We will cover floors and remaining furniture with plastic and drop cloths, but we are not liable for damage to items left in the work zone.

8.4. Pets and Children:
Keep pets and children away from the construction zone. The worksite contains sharp tools, heavy materials, and trip hazards. HouseTurnUp is not liable for injuries to unauthorized persons on site.

8.5. Neighbors:
You are responsible for notifying neighbors of construction activity if required by HOA or local ordinance. We will make reasonable efforts to minimize noise and dust.


9. Cancellation and Refunds

9.1. Cancellation by You (Before Work Starts):
You may cancel the project anytime before work begins. You will receive a full refund of your deposit minus any costs already incurred (permits pulled, materials ordered). Non-refundable permit fees and custom-ordered materials are not refundable.

9.2. Cancellation by You (After Work Starts):
If you cancel after work has begun, you will be billed for:

  • All work completed (at the fixed price percentage)

  • All materials already purchased (even if not yet installed)

  • Permit fees

  • 15% cancellation fee to cover demobilization costs

9.3. Cancellation by Us:
We may cancel the project if:

  • You fail to make payments as scheduled

  • You refuse necessary Change Orders for safety or code compliance

  • You deny site access for more than 7 days

  • We discover conditions that make the project impossible or unsafe (e.g., unstable soil, toxic mold, unpermitted existing work)

If we cancel, you will be billed only for work completed and materials purchased. No cancellation fee.

9.4. Refund Processing:
Refunds are processed within 14 days of cancellation agreement. Refunds are issued via the original payment method.


10. Limitation of Liability

10.1. Direct Damages:
Our total liability to you for any claim arising from our services is limited to the amount you paid us for the specific project.

10.2. Consequential Damages:
We are not liable for indirect, incidental, or consequential damages, including but not limited to:

  • Lost rental income (unless ADU build specifically guaranteed timeline)

  • Hotel or temporary housing costs (unless we caused uninhabitable condition beyond 7 days)

  • Lost wages, business interruption, or emotional distress

10.3. Property Damage:
We carry liability insurance to cover damage to your property caused by our negligence. You must notify us immediately of any damage (within 48 hours). Failure to notify may void coverage.


11. Dispute Resolution

11.1. Good Faith Negotiation:
If a dispute arises, both parties agree to first attempt to resolve it through good faith negotiation. Contact us at [email protected].

11.2. Mediation:
If negotiation fails, both parties agree to submit to non-binding mediation with a neutral mediator in Los Angeles County. Mediation costs are shared equally.

11.3. Arbitration:
If mediation fails, any dispute shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association (AAA). The arbitrator’s decision is final and enforceable in court.

11.4. Small Claims:
Either party may file a claim in small claims court if the amount in dispute is within the court’s jurisdiction ($10,000 or less).

11.5. Governing Law:
This Agreement is governed by the laws of the State of California.


12. Intellectual Property

12.1. Website Content:
All content on our website (text, images, logos, designs) is owned by HouseTurnUp or used with permission. You may not copy, reproduce, or distribute our content without written permission.

12.2. Project Photos:
We own the photos and videos we take of your project (see Section 13 of our Privacy Policy). You grant us permission to use project photos (without your face or identifiable property details) for marketing, portfolio, and social media unless you specifically opt out in writing.


13. Entire Agreement

13.1. These Terms, together with the signed Fixed Price Quote and any signed Change Orders, constitute the entire agreement between you and HouseTurnUp.

13.2. Any prior agreements, verbal promises, or representations not included in these documents are void.

13.3. If any provision of this Agreement is found unenforceable, the remaining provisions remain in full force.


14. Amendments

14.1. We may update these Terms from time to time. Changes will be posted on our website with a new “Last Updated” date.

14.2. For ongoing projects, the Terms in effect at the time of your signed quote apply.

14.3. Continued use of our website after changes constitutes acceptance of the new Terms.
